1. Agreement to Terms

By accessing or using Company ("the Service"), operated by earthservers.net ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Company is an end-to-end encrypted messaging platform that allows users to communicate in private channels, group servers, and direct messages. All message content is encrypted on the client side before transmission.

3. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials, including your encryption keys. You are responsible for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

Because Company uses end-to-end encryption, we cannot recover your encryption keys or messages if you lose access. You are solely responsible for backing up your keys.

5. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. You agree not to use the Service for any unlawful purpose or in violation of the AUP.

6. User Content

You retain ownership of content you create and share through the Service. Because messages are end-to-end encrypted, we do not have access to your message content. You grant us only the limited rights necessary to operate the Service (e.g., transmitting encrypted data between users).

7. Intellectual Property

The Service, its original content (excluding user content), features, and functionality are owned by earthservers.net and are protected by applicable intellectual property laws.

8. Termination

We may terminate or suspend your account at any time for violation of these Terms or the Acceptable Use Policy. Upon termination, your right to use the Service ceases immediately. Due to end-to-end encryption, we cannot selectively delete your message content from other users' devices.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, earthservers.net shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kamloops, British Columbia, Canada, without regard to conflict of law principles.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via the Service or email. Continued use after changes constitutes acceptance.
